By creating an account, tapping "I Agree," or using HealthyLifeOS (the "Service"), you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old to create an account.
HealthyLifeOS is a general wellness and fitness application. It helps you track health and fitness information from your devices, set wellness goals, log meals, hydration, and workouts, share progress with people you choose, and receive automated coaching suggestions about sleep, exercise, nutrition, hydration, and stress.
The Service is NOT: - A medical device, diagnostic tool, or treatment for any disease or condition; - A substitute for professional medical advice, diagnosis, or treatment; - A replacement for your doctor, nurse, therapist, or any licensed healthcare professional; - An emergency response, emergency monitoring, or life-safety service.
Content provided by the Service — including AI coach messages, voice conversations, readiness and recovery guidance, nutrition and calorie estimates, reference ranges, trends, alerts, and educational material — is for general wellness and informational purposes only.
Always consult a licensed physician or qualified healthcare provider for any decisions regarding your healthcare, including but not limited to: - Starting, stopping, or changing any exercise or fitness program; - Diet, nutrition, hydration, or weight management decisions; - Any medication, supplement, or treatment decision; - Mental and behavioral health concerns; - Interpreting any reading, trend, alert, or range shown in the Service.
No doctor-patient relationship is created by using the Service. Never disregard, avoid, or delay obtaining professional medical advice because of something you read, heard, or received from the Service or its AI coach. Reference ranges shown in the app come from public sources (such as the American Heart Association, CDC, ADA, and NIH) and are general educational information — only your physician can tell you what is normal or safe for you.
If you are not feeling well at any time — before, during, or after any activity suggested by the Service — STOP immediately. Seek help from a doctor, or dial 911 (or your local emergency number) for immediate assistance if you are experiencing a medical emergency, including symptoms such as chest pain or pressure, severe shortness of breath, fainting or severe dizziness, sudden weakness or numbness, confusion, or thoughts of harming yourself or others.
Never rely on the Service in an emergency. The Service's alerts, fall notifications, check-ins, and Care Circle features depend on third-party devices, operating systems, networks, and batteries, and may be delayed, inaccurate, or fail entirely. The Service does not contact emergency services on your behalf.
Physical exercise and changes to diet, hydration, and sleep routines carry inherent risks, including injury, aggravation of existing conditions, and, in rare cases, serious harm. By using the Service, you voluntarily accept and assume all risks associated with your use of the Service and any activity you choose to perform, whether or not suggested by the AI coach. You are responsible for exercising within your own limits and confirming with your physician that any activity is appropriate for you, especially if you are pregnant, elderly, or have any chronic condition, injury, or symptom.
You use this app and its coaching features at your own risk.
The Service depends on data from third-party devices and services (phones, watches, scales, cuffs, sensors, health records) and on automated estimation, including AI. Device readings can be wrong; syncs can fail; calorie and nutrition estimates from photos are approximations; AI-generated coaching can contain errors. We do not warrant that any data, estimate, range, alert, or suggestion is accurate, complete, or fit for any purpose. Verify important readings with medical-grade equipment and your healthcare provider.
If you invite others to your Care Circle, you consent to the Service sharing the health information you select with those individuals until you revoke access. Care Circle members receive information for awareness only; the Service does not guarantee they will see, receive, or act on any information or alert. Do not rely on the Care Circle as a safety or emergency system.
You are responsible for the accuracy of the profile information you provide (it is used to personalize your reference ranges), for maintaining access to your phone number and device, and for all activity under your account. You agree not to misuse the Service, attempt to access others' data, reverse engineer the Service, or use it for any unlawful purpose.
The Service offers auto-renewing subscriptions (monthly or annual) purchased through the Apple App Store or Google Play, including a 14-day free trial period. Unless you cancel at least 24 hours before the trial ends, your subscription begins automatically and your store account is charged. Manage or cancel anytime in your App Store or Google Play subscription settings; deleting the app does not cancel a subscription. Prices may change with notice as permitted by the app stores. Refunds are handled by Apple/Google per their policies.
By creating an account you agree to receive transactional communications (verification codes, receipts, security and legal notices, safety alerts you have configured) — these are part of the Service. With your account email we may also send product news, tips, and offers relevant to your subscription; you can opt out anytime via the unsubscribe link in any such email or in Settings → Notifications → Communications, and we will honor it promptly. Marketing text messages are sent only if you explicitly opt in, and you can revoke that consent at any time by replying STOP or in Settings. Opting out of marketing never affects transactional or safety communications. We deliberately limit the volume of promotional communications.
Our collection and use of your information, including health information, is described in our Privacy Policy (companion document: HealthyLifeOS_PrivacyPolicy), which is incorporated into and forms part of these Terms. We do not sell your health data and do not use it for third-party advertising.
The Service, including its software, design, content, and AI outputs, is owned by BR Product Factory, LLC or its licensors. We grant you a personal, non-transferable, revocable license to use the Service for your own non-commercial wellness purposes.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AVAILABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA, ALERT, OR COACHING OUTPUT WILL BE ACCURATE OR DELIVERED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BR PRODUCT FACTORY, LLC, ITS OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, HEALTH OUTCOME, LOSS OF LIFE, LOST DATA, OR LOST PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY COACHING SUGGESTION, ANY ALERT OR FAILURE TO ALERT, OR ANY DEVICE OR DATA ERROR — FOR ANY REASON AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain exclusions; in those jurisdictions, these limits apply to the fullest extent permitted.
You agree to indemnify and hold harmless BR Product Factory, LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any law or third-party right.
We may update the Service and these Terms; material changes will be notified in-app, and continued use constitutes acceptance. You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms.
These Terms are governed by the laws of the State of Colorado, USA. Venue and further dispute-resolution terms will be finalized upon counsel review and posted here with notice.
